Carl Dobler

Hallo Laserlicht,

ist dir eigentlich bewusst, dass urheberrechtliche Schutzfristen in fast allen Ländern (so auch in Deutschland) immer bis zum Jahresende laufen? D. h., Dobler mag am 31. Mai 1954 gestorben sein, aber seine Werke werden nicht am 1. Juni 2024 gemeinfrei, sondern erst am 1. Januar 2025. Die Dobler-Dateien sind also allesamt noch nicht ok für Commons und auch Wikipedia. Danke für deine Antwort. Sorry das war mir tatsächlich nicht bewusst. Geht aus den vorlagen und Informationen hier in der Wiki leider auch nicht so richtig hervor. Oder habs einfach nicht gesehen.
Die meisten Bilder (Bildermappe) betrifft das allerdings nicht. Der ist durch das Stadtarchiv unter CC-BY lizenziert.
Wie gehen wir mit den Bildern um? Von Dobler ist angeblich auch kein Rechtsnachfolger bekannt (müsste die Info nochmal raussuchen).
Löschen und nach 6 Mon wiederherstellen lassen? Oder irgendwie einen Hinweis einbauen?

bzgl. Frist: Das steht bei den Seiten zum Urheberrecht in den jeweiligen Staaten im Kasten rechts, bspw. Commons:Copyright rules by territory/Germany/de: Frist geht bis zum Jahresende: Ja.
Hat das Stadtarchiv vollumfängliche Nutzungsrechte an diesen "Bildermappe"-Bildern? Nur dann können sie die Bilder unter CC-Lizenzen freigeben; die Bilder gescannt zu haben, reicht da nicht.
Bzgl. weiteren Dateien: Irgendeinen Rechtsnachfolger gibt es immer, wenn gar niemand sonst in Frage kommt, ist es der Staat (Bundesland). Mein Vorschlag wäre: löschen (kann ich machen) und auf der Seite der entsprechenden Wiederherstellungskategorie eintragen, also Category:Undelete in 2025. Allerdings nur bei Erscheinungsjahren bis einschließlich 1929. Bei allen späteren läuft das US-Urheberrecht noch (95 Jahre ab erster Veröffentlichung), und das ist hier auch zu beachten (Commons:Licensing/de). Fuchs Leuchthaar zum Beispiel ist von 1946, das geht hier erst ab 2042. Die Rätsel von 1938 gehen ab 2034. Wenn partout gar kein Jahr bekannt ist, 95 (+ 1) Jahre nach dem Tod, also 2050. Lokal in der deutschsprachigen Wikipedia könntest du diese Dateien ab 2025 hochladen, da spielt das US-Urheberrecht keine Rolle. Gruß --Rosenzweig τ 08:25, 3 June 2024 (UTC)[reply]
Danke für die Klarstellung.
Zur Bildermappe: Die wurde im Rahmen von codingdavinci freigegeben. Da würde ich davon ausgehen, dass das passt. Außerdem - wie du ja bereits meintest: Wenn kein Rechtsnachfolger bekannt ist, dann läge das Recht sowieso beim Staat (auch wenn Stadt und Land, ggf. nochmal ein bisschen verschiedene paar Schuhe sind...).
Für mich okay, das Vorgehen. D.h. die werden dann quasi ohne Zutun wiederhergestellt?
Bei der Postkutsche und Heuwagen vor Wirtshaus würde ich mal noch beim Stadtarchiv anfragen, ob die dazu ein Datum haben, dass man auf der Datei-Seite vermerken (und zur Wiederherstellung nutzen) könnte.

Die Undelete-Kategorien werden immer zu Jahresbeginn abgearbeitet, was dann gemeinfrei geworden ist, wird wiederhergestellt. Siehe bspw. Category:Undeleted in 2024 für die diesjährige Ausbeute. Gruß --Rosenzweig τ 19:04, 3 June 2024 (UTC)[reply]
